General Provisions
As a consumer, the Client of OVIDIUDRAGOSARGESANU has the right to withdraw from a distance sales contract by returning the ordered products without any justification, within a maximum of 30 calendar days from the date of taking possession of the purchased goods. The procedure for withdrawal from the contract is detailed in Section 2 of this policy – Withdrawal Procedure.
Furthermore, if the product is found to be non-compliant, you will have the option to return it to OVIDIUDRAGOSARGESANU and request that the seller brings it into compliance free of charge, through repair, replacement, appropriate price reduction or, where applicable, termination of the contract regarding this product and reimbursement of its value. If the consumer identifies defects in the product within the first 30 days of purchase, direct replacement will be arranged.
This right of return due to non-compliance can be exercised if the lack of conformity occurs within 2 years, calculated from the delivery of the goods.
Any intention to return must be communicated to OVIDIUDRAGOSARGESANU by sending a request via email to info@ovidiudragosargesanu.ro or by submitting the withdrawal form, as provided below.
Withdrawal Procedure – Withdrawal Form
In accordance with Government Emergency Ordinance 34/2014, a client who is a consumer (natural person) has the right to withdraw from the contract, i.e., to return the ordered goods, within 30 calendar days without stating any reason.
The client must return the products without undue delay and no later than 14 days from the date on which they communicated the decision to withdraw from the contract.
OVIDIUDRAGOSARGESANU will reimburse all amounts received as payment from the consumer, minus the costs of delivering the product to the consumer, without undue delay and, in any case, no longer than 14 days from the date the package reaches OVIDIUDRAGOSARGESANU’s warehouse and its compliance is verified.
The buyer will only bear the costs of delivery related to the return of the products.
The reimbursement of the amount corresponding to the purchased products will be made using the same payment method used for the initial transaction, unless the client expressly agrees to use another method. The reimbursement will take place after receiving the products returned by the client or after receiving proof of shipment provided by the client.
To exercise the right of withdrawal, the consumer informs OVIDIUDRAGOSARGESANU of their decision to withdraw from the contract using an unequivocal statement. The return form can be downloaded via the following link and after completion, it should be sent to info@ovidiudragosargesanu.ro . Alternatively, the text of the return form can be included directly in an email, as shown below:

The returning of products can be carried out in two ways, depending on the client’s preference. For returns made through Posta Romana, the address is:

The return of purchased products can take place without providing any reason. Products must be properly packaged for the return and accompanied by all original accessories and documents, as well as a copy of the invoice/ receipt.
Returning a product without its accessories will result in a reduction of its value, as described below.
Products showing physical alterations, impacts, chips, scratches, stains, shocks, etc., are not accepted for return.
If it is found that the value of the product has been diminished, OVIDIUDRAGOSARGESANU will retain the amount corresponding to this reduction.
Refund for product value will be reimbursed as it follows:
- For orders paid by online card – the refund will be made to the account from which the payment was made unless another account is explicitly indicated in writing for the transfer of the refund amount.
- For orders paid by bank transfer, cash on delivery or back card – the refund will be made by bank transfer to the account indicated in writing by the buyer.
Depending on the nature of the products sold on the www.ovidiudragosargesanu.ro website, some may be sealed. Based on the condition and type of returned product, it will be determined whether the refund can be accepted.
All prices of goods displayed on the site, regardless of their specifics, include VAT and are final prices.
Reduction of the value of goods
The buyer will only be held responsible for the reduction in the value of the goods resulting from handling other than what is necessary to determine their nature, characteristics and functioning. If the returned product shows signs of wear, scratches, impact, missing accessories, missing warranty certificates, etc., the consumer is responsible for the resulting decrease in value.
If a consumer exercises the right of withdrawal after using the goods to a degree that exceeds what is necessary to determine their nature, characteristics and functioning, they are liable for any reduction in the value of the products.
The final value of the product will be determined based on the value of the components/ elements that need replacement and the cost of reconditioning, or as the difference between the initial value of a new product and the resale value of the used product, if the operation is possible. The reduction fee will be communicated to the client upon receipt and inspection of the products.
The returned products must be accompanied by the original warranty certificate, if issued by the manufacturer.
If the returned products included any bonuses/ gifts, the buyer must also return these alongside the product. Otherwise, their value will be deducted from the refund.
If multiple products of the same type were purchased and the return of all these products is requested, the consumer must ensure that only one of these products has been unsealed. The return of the other products is accepted only if they remain sealed.
The consumer cannot exercise the right of withdrawal for the supply of sealed goods that cannot be returned for reasons of health protection or hygiene, and shich have been unsealed by the consumer.
Goods exempt from return:
- Products made according to the specifications provided by the consumer or clearly personalized;
- Supply of products that are liable to deteriorate or expire rapidly;
- Supply of sealed products that cannot be returned for reasons of health protection or hygiene, and which have been unsealed by the consumer;
- Supply of sealed audio or video recordings or sealed software, which have been unsealed after delivery;
- Supply of products that, after delivery, due to their nature, are inseparably mixed with other items;
- Gift cards sent electronically;
- Contracts for the supply of digital content (ex. ebooks) not delivered on a tangible medium, if execution has begun and, in cases where the contract creates an obligation to pay for the consumer, provided that:
(i) the consumer has given prior express consent to begin the execution furing the withdrawal period;
(ii) the consumer has acknowledged that they will lose their right of withdrawal as a consequence;
(iii) the professional has provided confirmation of the conclusion of the contract.
Return of products for non-conformities
Considering the nature of the products distributed by OVIDIUDRAGOSARGESANU, the warranty refers specifically to the initial condition of the products, thus, upon receiving an order, in the event of printing errors (covers or content reversed, missing or extra pages, etc.) or missing or defective parts in the case of games, the client must check and report any discrepancies to OVIDIUDRAGOSARGESANU.
The consumer may exercise the right of return if the product presents non-conformities, provided that the lack of conformity occurs within 2 years from the delivery of the product.
If deficiencies are found within the first 30 days from the purchase of the product, direct replacement will be made.
Following verification, OVIDIUDRAGOSARGESANU will replace the defective product with a conforming one or, if out of stock, will refund the client the amounts paid without additional fees or costs for the client.
Products arriving in non-conforming conditions due to transportation or other causes will be replaced under the same conditions.
The client must report non-conformities immediately, and in any case within 30 days from the date of noticing the non-conformity, by informing OVIDIUDRAGOSARGESANU via the contact phone number, email info@ovidiudragosargesanu.ro or by completing the form available in the CONTACT section.
The warranty is void in the following cases:
- The buyer has not respected the conditions of use, maintenance, etc.;
- The product was stored improperly, exposed to unfavorable conditions or handled incorrectly;
- Mechanical damage caused by striking the product;
- The product was modified or repaired beforehand by unauthorized people.
The time period established for replacing the returned products shall not exceed 15 calendar days from the moment the seller is informed of the non-conformity.
The buyer is not entitled to request termination of the contract if the non-conformity is minor.
OVIDIUDRAGOSARGESANU does not provide a commercial warranty for the products sold through www.ovidiudragosargesanu.ro .
In case of non-conformity of games purchased from www.ovidiudragosargesanu.ro , the products will be replaced. If replacement is not possible, such as but not limited to out-of-stock situations, the client will be refunded the amounts paid for that product.
Responsibility for defects rests with the importer/ distributor.
Electronic books are considered compliant if:
- They match the description, quantity, quality and possess the functionality, compatibility, interoperability and other characteristics stipulated in the contract;
- They are provided alongside all accessories, instructions (including installation) and all customer support services as per the contract;
- They meet the specific purpose for which the consumer requested them, which the client communicated to OVIDIUDRAGOSARGESANU no later than the conclusion of the contract and which the seller accepted;
- They are provided with updates according to the contract;
- They meet the purposes for which electronic books of the same type are normally used;
- They match the quantity and possess the required qualities and performance characteristics;
- When applicable, they are provided with any accessories and instructions that the user could reasonably expect to receive;
- They comply with any trial or demonstration version of the digital content or digital service made available by OVIDIUDRAGOSARGESANU prior to the conclusion of the contract.
The client is responsible for verifying the compatibility of the electronic formats available on www.ovidiudragosargesanu.ro with their device. Secured digital books cannot be converted into other formats. OVIDIUDRAGOSARGESANU cannot return, convert or provide the client with formats other than those purchased and available on the website at the time of the transaction.
Secured digital books in PDF and EPUB formats distributed by OVIDIUDRAGOSARGESANU can only be accessed through the ADOBE DIGITAL EDITIONS software platform. Prior to accessing the digital books, Adobe Digital Editions authorization with an Adobe account is mandatory. Otherwise, books accessed even once on an unauthorized device can only be read on that device.
Moreover, if a digital book was opened with unauthorized Adobe Digital Editions and is subsequently authorized, the books downloaded and accessible before authorization will become unavailable. In this situation, OVIDIUDRAGOSARGESANU will not refund the ebook nor resend another copy of the digital book in a version where the user license has not yet been applied.
Information required for returns
To benefit from the product conformity warranty, the buyer must notify the lack of conformity to the provider by completing the contact form, sending the request via email to: info@ovidiudragosargesanu.ro or by contacting the seller via the phone number: 0721 908 140.
The return of products will be carried out as described below. Items returned to the seller without a prior return request will not be accepted.

The sender is responsible for both the accuracy of the data entered on the transport document (AWB) and for the proper packaging of parcels containing the returned products.
Parcels sent by the sender must be packaged in a manner that protects the product from factors that may cause damage during the entire transport period (it is recommended to use protective materials, ex. polyester, cardboard, bubble wrap, etc.). Additionally, it is recommended to package the parcel in accordance with the weight, shape and nature of the contents, as well as the mode and duration of transport. The packaging must protect the contents so that they cannot be damaged by the pressure or repeated handling and may, where appropriate, consist of cardboard boxes, plywood, wood, plastic filled with polystyrene, etc.
